Vendor Terms & Conditions
Please read carefully. This document sets out the Terms & Conditions that govern participation as a vendor at Rocky Point Market. It is provided together with the vendor application and must be agreed to before an application will be considered.
1. Acceptance of Terms
By submitting a vendor application and/or participating in Rocky Point Market ("the Market," "we," "us," or "our"), you ("Vendor," "you," or "your") agree to be bound by these Terms & Conditions in full. If you do not agree to these terms, please do not submit an application or participate as a vendor.
2. Vendor Application & Approval
Submission of an application does not guarantee acceptance or a vendor space at this or any Rocky Point Market event.
The Market reserves the right, in its sole discretion, to approve, decline, or waitlist any application, and to limit the number of vendors offering similar merchandise.
Approved vendors will be notified by email and provided a separate Vendor Information Packet containing event-specific logistics.
3. Permitted Merchandise — This Market
Permitted items are outlined in the “Featured Market” informations sections.
Vendors found selling non-permitted items may be required to remove those items from display immediately and/or may be asked to leave the Market without refund, at the sole discretion of Market organizers.
Approval for a specific market date applies only to that date's stated merchandise category.
4. Vendor Fees, Cancellations & Refunds
Rocky Point Market maintains a general no-cancellation, no-refund policy. Once a vendor fee has been submitted, it may be final and will not be refunded for any reason, including but not limited to a change of plans, illness, weather, personal emergency, or a Vendor's decision not to attend.
This policy may apply depending on how much advance notice is given.
5. No-Show Policy
A "no-show" is a vendor who has been confirmed/approved for a market but fails to arrive and set up within the designated setup window without prior notice to Market organizers.
No-shows will not receive a refund of any fees paid.
Repeated or unexplained no-shows may affect a vendor's eligibility to apply for or be approved for future Rocky Point Market events, at the sole discretion of Market organizers.
Vendors who know in advance that they cannot attend are asked to notify organizers as a courtesy; this does not entitle the vendor to a refund.
6. Booth Space & Sales Area
Each vendor is assigned a specific table/booth space for the market.
Sales activity, displayed merchandise, signage, and vendor belongings must be confined to the vendor's assigned table area. Only items that fit on, under, or behind your assigned table are permitted.
Vendors may not expand into walkways, aisles, neighboring vendor spaces, or fire exits.
The Market reserves the right to reassign or adjust vendor spacing as needed for safety or operational reasons.
7. Vendor Name Tags & Building Access
All vendors will be issued a sticker at check-in, which must be worn and visible until the end of the event.
Stickers are required for entry into and exit from the building throughout the market, including during breaks or supply runs.
Vendors without a visible sticker may be denied re-entry.
8. Vendor Conduct, Safety & Fair Dealing
By participating, Vendor agrees to:
Set up and operate their booth safely, maintaining safe physical spacing and clear walkways for patrons and other vendors.
Follow all instructions from Market organizers, staff, and volunteers, as well as all venue rules.
Engage only in honest, good-faith transactions. Fraudulent activity, counterfeit goods, price manipulation, scams, or deceptive selling practices of any kind are strictly prohibited and will result in immediate removal from the Market without refund.
Refrain from any illegal, unsafe, disruptive, or harassing behavior toward patrons, other vendors, staff, or volunteers.
9. Security of Merchandise & Personal Property
Vendor is solely responsible for the security of their own merchandise, cash, displays, and personal property at all times.
Rocky Point Market, its organizers, staff, volunteers, and the venue do not provide security guarantees and are not responsible for lost, stolen, or damaged items.
10. Release of Liability & Indemnification
Vendor participates in the Market at their own risk. To the fullest extent permitted by law, Vendor releases and holds harmless Rocky Point Market, its organizers, staff, volunteers, and the venue/property owner (collectively, the "Released Parties") from any and all claims, damages, injuries, losses, or liabilities arising from or related to Vendor's participation in the Market — including property damage, personal injury, theft, or disputes between vendors and patrons or other vendors.
Vendor agrees to indemnify and hold the Released Parties harmless from any claims, damages, or costs (including legal fees) arising out of Vendor's actions, products, or omissions, except where caused by the Released Parties' gross negligence or willful misconduct.
Vendor is encouraged to carry their own liability insurance for their goods and booth. The Market does not provide insurance coverage for vendor merchandise, displays, or booths.
11. Booth Cleanup & Waste Removal
Vendors are solely responsible for keeping their booth and immediate surrounding area clean throughout the event.
At the end of the market, Vendor must remove all unsold merchandise, garbage, packaging, hangers, and personal equipment, leaving the space as clean and tidy as it was found.
Vendors who fail to properly clean up their space may be charged a cleaning fee and/or have this factored into their eligibility for future markets.
12. Compliance with Laws & Taxes
Vendors are solely responsible for complying with all applicable federal, provincial, and municipal laws, including any tax obligations (e.g., GST/PST) or business licensing requirements that may apply to their sales.
Rocky Point Market does not provide tax or legal advice to vendors and recommends vendors consult a qualified professional regarding their individual obligations.
13. Photography & Promotional Use
Rocky Point Market may photograph or film the event for promotional and marketing purposes, which may include vendor booths and merchandise. By participating, Vendor consents to such use.
14. Event Changes & Cancellation by the Market
Rocky Point Market reserves the right to modify event details (e.g., timing, layout, booth assignments) or, in rare circumstances, cancel or postpone the event due to circumstances beyond its control.
If the Market cancels the event entirely, organizers will communicate next steps to vendors; however, this does not obligate the Market to issue refunds.
15. Right to Remove & Enforce
Rocky Point Market reserves the right to remove any vendor from the event, without refund, for violation of these Terms & Conditions or for conduct deemed unsafe, disruptive, fraudulent, or otherwise inappropriate.
16. Amendments
These Terms & Conditions may be updated from time to time. The version in effect at the time of application governs that vendor's participation unless otherwise communicated.
17. Governing Law
These Terms & Conditions are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
18. Acknowledgement
By submitting your vendor application, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions in full.
